The service
Molo is a course in isiXhosa for English and Norwegian speakers, provided by Hardmax AS (org. nr. 936 143 202, Brinken 19A, 0654 Oslo, Norway). The free tier is paced with hearts; Molo Plus is a subscription that removes the pacing and adds perks.
In the free tier you have up to five hearts; a wrong answer costs one, and hearts refill automatically over time (one heart every four hours, shown in the app) or when you practise. Hearts cannot be bought. Molo Plus removes the hearts limit. Streaks and leagues are optional motivation features and never affect what you have paid for.
Your account
Keep your sign-in private, and keep a working email address on your account; if you switch off Apple's email forwarding, you may not receive password-reset or receipt emails. You must be at least 13 years old to use Molo. If you are under 18, you confirm that a parent or guardian allows you to use Molo, and any purchase of Molo Plus must be made with their permission — for example through Apple Family Sharing / Ask to Buy or Google Family Link. If you live in South Africa, you must be 18 or older. Molo is a consumer service; schools and other organisations may not enrol pupils without a written agreement with Hardmax AS. You may delete your account at any time in Settings or at hellomolo.com/delete-account.
Molo Plus
Molo Plus is an auto-renewing subscription (monthly NOK 79 / USD 6.99, yearly NOK 599 / USD 49.99; other currencies and the tax-inclusive total are shown before you pay). It renews at the same plan length and price until you cancel; cancel at any time and you keep Plus to the end of the paid period. The price, billing period and renewal terms are shown on the purchase screen before you subscribe; manage or cancel in the App Store, Google Play or your web-billing account.
Who you buy from: on iOS you buy from Apple Distribution International Ltd (Ireland), on Android from Google Commerce Limited (Ireland), and on hellomolo.com from Hardmax AS. On iOS the Apple standard EULA (Licensed Application End User License Agreement) also applies to the app licence.
Right of withdrawal (angrerett): if you buy on the web you may withdraw within 14 days of purchase in Settings → Molo Plus, by emailing support@hellomolo.com or by using the standard withdrawal form (angreskjema); checkout requires your express request for Plus to start immediately. If you withdraw, you pay only for the proportion of the paid period already supplied, and we refund the rest within 14 days of your notice. Without an express request we make no deduction for use. The purchase day is excluded from the 14-day calculation; a deadline on a weekend or Norwegian public holiday moves to the next working day. For App Store and Google Play purchases, Apple's and Google's withdrawal terms apply and you request it from them.
Price changes: we give at least 30 days' notice in the app and by email; you can cancel free of charge before the new price applies.
Prices are shown in the checkout in your local currency and include VAT or other taxes where they apply (Norwegian MVA, EU VAT, UK VAT); the seller named in the checkout (Apple, Google or Hardmax AS) issues the receipt or invoice. On the App Store and Google Play, Apple or Google is the seller and accounts for any South African VAT.
Refunds. Something wrong with Plus? Wherever you bought it, you can complain to us (reklamasjon) under the Norwegian Digital Services Act (digitalytelsesloven) and EU rules: we fix it, replace it, reduce the price or refund you (retting, omlevering, prisavslag, heving), and we cannot contract out of this. Changed your mind? Web purchases: 14-day right of withdrawal (angrerett) with a pro-rata refund, see above; after that, cancelling stops the next renewal and you keep Plus until the period ends. App Store or Google Play purchases: the refund is handled by Apple or Google under their terms (including your 14-day withdrawal right against them); ask them first, and contact us if they refuse and you believe Plus was defective.
Content
Course content is checked by isiXhosa editors, but a language course can contain mistakes; tell us and we will fix them.
Lexicon. Our isiXhosa lexicon is adapted from the IsiXhosa.click dictionary database (isixhosa.click), a student-led project supported by the University of Cape Town and SADiLaR, which its contributors publish under the Creative Commons Attribution-ShareAlike 4.0 licence (CC BY-SA 4.0). We have changed it: glosses are rewritten for learners, Norwegian glosses and usage notes are added, and entries are reviewed by our editors. Because that licence is share-alike, our adapted lexicon (the isiXhosa headwords, glosses, usage notes and example sentences shown in the dictionary parts of Molo) is itself licensed to everyone under CC BY-SA 4.0. We make it available as a data package with the attribution and licence files — at hellomolo.com/lexicon — and you may copy and redistribute that package under CC BY-SA 4.0. Nothing in these terms (including the rule against scraping) limits what CC BY-SA 4.0 allows you to do with the lexicon data.
Audio. Some pronunciations are provided by Forvo (forvo.com) under a commercial licence from Forvo Media S.L. and are shown with the "Pronunciations by Forvo" credit. The rest are recorded by our paid speakers under written agreements. Audio is not part of the CC BY-SA lexicon package and you may not copy, extract or redistribute it; you may play it in Molo for your own learning.
Reports and feedback. You can report a problem with an exercise or send us suggestions. Reports are read by our team and editors and are not published. By sending a report or suggestion you give Hardmax AS a non-exclusive, worldwide, royalty-free, perpetual licence to use it to correct and improve Molo, including by adding corrected glosses, notes or example sentences to our lexicon, which we publish under CC BY-SA 4.0. We do not credit individual reporters. Do not include personal information about other people in a report.
Ours. The app, its code and design, the mascots, the curriculum, the exercises and our own recordings are the copyright of Hardmax AS (or our licensors). You may use them for your own learning and not copy, extract or redistribute them. "Molo", the Molo logo and the mascots are trade marks of Hardmax AS™ (registration pending); "molo" is also simply the isiXhosa greeting, and we claim no rights in the word as used in ordinary language or in other people's isiXhosa teaching.
Acceptable use
No abuse of other learners in leagues, no attempts to break the service, no scraping (this does not limit what CC BY-SA 4.0 allows you to do with the lexicon package). Your league display name (your first name by default) is visible to other learners in leagues. You can change it or opt out of leagues in Settings. Choose a name that is not offensive, misleading or someone else's; we may change or hide names that break this rule. Report abuse to abuse@hellomolo.com.
Our responsibility
We provide Molo with the care and quality you can reasonably expect (digitalytelsesloven §§ 7–8). If Molo is defective we are liable for the loss you could reasonably foresee, but not for loss in a business, and never for anything the law does not let us exclude. Nothing in these terms limits the rights you have as a consumer under the law of the country where you live, including Norwegian and EU/EEA law and, for users in South Africa, the Consumer Protection Act 68 of 2008.
Changes
We may change these terms to reflect changes in the law, in the stores' rules, in our prices or in Molo's features. We give at least 30 days' notice in the app and by email before a change that affects you takes effect. If a change is to your disadvantage and you do not accept it, you may end your subscription free of charge before it takes effect and we refund any prepaid unused period.
Law
Norwegian law applies; disputes go to the courts of Norway, without prejudice to consumer rights in your country. If you live in South Africa, you may also bring a complaint or claim under South African consumer law in South Africa.
If you are in South Africa
Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002, which apply regardless of the choice of Norwegian law. Web purchases of Molo Plus start immediately with your consent, so the 7-day cooling-off right in section 44 of the ECT Act does not apply, but you keep the 14-day withdrawal right described under Molo Plus; if you buy a yearly plan on the web you may cancel on 20 business days' notice and we will refund the unused part less a reasonable cancellation charge, and we will remind you before a yearly plan renews. Purchases through the App Store or Google Play are made with Apple or Google under their terms and refund rules. Our company details for the ECT Act are at hellomolo.com/legal/company. If we cannot resolve a complaint, you may contact the National Consumer Commission (012 065 1940; https://eservice.thencc.org.za/). The "Our responsibility" section above limits our liability only to the extent the Consumer Protection Act allows.
Language
These terms exist in English and Norwegian. Both versions have the same meaning and are equally binding. If they differ, the version in the language you were using in Molo when you accepted the terms applies to you. For consumers in Norway, the Norwegian version applies.
